Del City board approves garage-to-living-space variance with driveway, storage conditions

On Feb. 9, 2026, the Del City Board of Adjustment voted to approve a building code variance (BABCV211-26) allowing the conversion of a garage at 4201 Southeast 44th Street into interior living space, provided the applicant widens the driveway to accommodate two cars and installs a 10-by-10 storage structure to replace lost garage storage.
City staff introduced the application for Sunny Polipra on behalf of Quality Homes and Construction Incorporated and told the board that it "does recommend denial of b a b c v 211 — their garage conversion at 4201 Southeast 44th Street" unless the applicant repairs and expands the driveway and "includes a storage building to accommodate for lost storage in the garage." Staff also said the city has a signed affidavit from the applicant regarding ownership despite county assessor records listing a different owner.
Board members asked questions about the property and how the city would ensure required work is completed. One member pointed to assessor records listing a different name and asked whether that was a concern; staff replied that "the tax assessor records are a bit behind" and that the office "has a signed affidavit that they are the property owner." On address and contact information, staff advised using the residence address (4201 Southeast 44th) for service of documents and confirmed that contact information is available if required.
During discussion board members clarified the physical conditions they expected: a widened driveway sufficient for two vehicles (discussed as roughly 16 feet wide) and an on-site storage structure to make up for lost garage storage. Staff noted there is no minimum shed size in current requirements but said the storage must "make up for the lost storage." Staff also explained that the applicant must obtain miscellaneous building permits and pass inspections for the driveway and shed before receiving a certificate for the garage conversion: "They would have to get their permits... and then we would inspect those. After those things have been inspected and passed, then they can go ahead and start building their garage conversion."
Board Member (Speaker 3) moved to approve the variance "with stipulation that the driveway is widened to a 2 car lane, and there is an additional 10 by 10 structure placed in the back for storage." The motion was seconded and passed by voice vote.
