Delegate Delia Webber introduced HB 1087 as a narrowly tailored option allowing high energy‑use facilities (defined in the bill as customers requiring 30 megawatts or more of uninterrupted service) to own and operate on‑site natural gas fuel‑cell generation. "Fuel cells are not combustion generators ... they are significantly cleaner than traditional combustion‑based generation," Webber said, arguing the technology can provide dispatchable base‑load power where demand exists and reduce reliance on diesel backups.
Supporters included Appalachian Power and the Virginia State Building and Construction Trades Council, which said fuel cells can bridge reliability gaps and fit a diverse energy portfolio. Amanda Cox of Appalachian Power said the company has some systems in operation and finds them effective for bridging short‑term gaps.
Environmental and conservation groups opposed the bill. Josepha Salman of the Southern Environmental Law Center warned that the bill "goes the opposite direction and doubles down on a fossil fuel," and raised concerns about firm pipeline capacity during extreme weather periods. Other witnesses said fuel‑cell manufacturers sometimes propose using the systems as primary generation, which could raise questions about year‑round fuel availability and the need for new pipeline infrastructure.
The subcommittee voted to table HB 1087 by a recorded vote of 4 to 3.
