Council approves targeted change to subdivision language to avoid automatic vacation for permit errors

The Sulphur City Council on Feb. 9 approved an amendment to a previously adopted subdivision ordinance (cited as Ordinance 06-26) that removes an automatic vacation clause tied to commencing work before obtaining permits and instead preserves other legal remedies.
An attorney working on a construction title issue asked the council to soften language that would automatically render a subdivision "null and void" if any work began before permits were obtained. The attorney said the strict clause interfered with property owners’ ability to secure title insurance. She offered substitute language that keeps the city’s preexisting rights and makes improvements subordinate to recorded rights of way and easements, while reserving available legal remedies for permit violations.
Council members discussed the proposal, noting that owners still must obtain applicable permits and that the substituted language retained enforcement options: fines, penalties, damages and injunctive relief. The motion to amend was moved and seconded; the council carried the ordinance modification by roll-call vote.
Supporters said the change was narrowly tailored to resolve a title-insurance issue in this case while preserving the city’s authority to protect preexisting public rights and easements. No public speaker opposed the amendment during the hearing. The council approved the amendment and the ordinance as amended.
