A land development plan for a 36-by-50 restaurant at the corner of Mulberry and Via Bella proposed by Allen Emerson Company won council approval on Feb. 5 after plan revisions addressed planning commission concerns.
The developer’s representative said the updated plan replaces drive-in parking with angled stalls (17 provided), substitutes a fenced refuse area using cans instead of a dumpster because of lot constraints, adds landscaping, and includes minor grading. The plan was reviewed by stormwater and planning staff; planning recommended approval 4–2 with one member absent.
Council members pressed staff about architectural elevations, the certificate of appropriateness for the downtown design standards, and whether neighboring properties were notified. The developer said franchise details remain under contract and will be disclosed after approvals. Councilmember Felizzi asked whether a nearby religious establishment required any waiver concerning alcohol distribution; staff answered that the Central Business District zoning permits the proposed use and no waiver was required.
What’s next: If council approval stands, architects will submit full elevations and building-permit documents for codes review and a subsequent certificate-of-appropriateness to ensure compliance with downtown standards. Council approved the land development motion 5-0.
