The McAllen City Commission on Feb. 9 voted to disapprove a proposed amendment to the planned unit development (PUD) at 1300 South 10th Street, after city staff recommended resolving the developer’s request through an amendment or extension to an existing 380 agreement.
Developer Michael Fowlitz (listed in the file as Michael Fowlitz) told commissioners the proposed change — using an area as interim parking while vertical development proceeds — was a timing decision and not an alteration of the project’s ultimate use. “It is just really a timing issue,” Fowlitz said.
City management replied that the property is subject to an existing 380 agreement and that “resolving the issue presented by the developer may be better handled through an extension, an amendment to the 380 agreement rather than an amendment to the PUD,” the city manager said.
Planning staff and commissioners debated whether the interim parking would require a formal PUD site-plan amendment or could be addressed administratively; some commissioners expressed concern that amending the PUD now could create future conflicts if the developer later returns to build the hotel.
Given that uncertainty and the manager’s recommendation, the commission voted to disapprove the PUD amendment and instructed staff to work with the developer on alternative approaches including the 380 agreement.
