Kane County committee debates rejected landscaping bid and appeal process

A dispute over a landscaping contract repeatedly returned to the Kane County Administration Committee on Feb. 11 as members debated whether to accept the second-lowest qualified bidder after the board voted to reject the originally awarded contractor.

Multiple committee members recounted years of complaints about the vendor’s performance on weeding and upkeep, while others cautioned that the board had already voted to reject the bid and should not relitigate that decision. Building-management staff said purchasing recommended either pursuing a scope review with the next-lowest responsible bidder or rebidding, and warned that timing for spring landscaping work made a quick decision desirable.

A county attorney said the applicable county ordinance was unclear on this procedural path and noted there are appeal rights; the attorney asked for time to review potential liability and to advise on whether the purchasing director must notify the original bidder and how an appeal might proceed. Committee members asked staff to work with purchasing and the state’s attorney and to consider a special administration meeting or executive committee referral so work could proceed in time for March board action.

No final procurement award was made at the meeting; staff said they would consult purchasing and legal counsel and return with a recommended procedural path to protect the county from appeal-related liabilities.

Next steps: staff will seek legal clarity on the ordinance’s appeal process and report back to the committee before finalizing vendor selection or rebidding.
