Boynton Beach commission unanimously approves land-use change, rezoning and site plan for Josie’s restaurant at 3047 N. Federal Highway

The City of Boynton Beach City Commission on Feb. 10 unanimously approved a future land-use amendment, a rezoning and a major site plan that together clear the way for a 4,733-square-foot Josie’s restaurant at 3047 North Federal Highway.

The ordinances were considered on second reading. The clerk read Ordinance No. 26-002, which would change the future land use designation for the northern approximately 0.72-acre portion of a roughly 1.3-acre unified property at 3047 North Federal Highway from special high-density residential to general commercial, and Ordinance No. 26-003, which would rezone that same northern portion from IPUD (infill planned unit development) to C-3 community commercial while leaving the remaining acreage under its existing IPUD zoning. The commission also considered a companion major site plan application for a new 4,733-square-foot structure for Josie’s restaurant at the same address; the site plan approval was conditioned on the companion land-use and rezoning approvals.

John Stout, planner with the city’s Planning and Zoning Department, told commissioners there were no changes to the applications since the prior hearing. "There are no changes," Stout said.

The commission permitted public comment once for all three items; no members of the public spoke on the applications. After brief procedural disclosures by commissioners — including Commissioner Turkin’s statement that he had received an email from Bradley Miller regarding the items — the commission moved to approve the ordinances and the site plan on second reading. Roll-call votes recorded Commissioners Kelly, Turkin and Cruz, Vice Mayor Hay and Mayor Shelton as voting yes on each item; all motions passed unanimously.

The approvals now authorize the land-use designation change, the rezoning of the northern parcel to community commercial and the major site plan permitting construction of the restaurant subject to the terms in the approved applications and any conditions adopted by the commission. The record as read into the meeting file describes the property as the northern ~0.72-acre portion of a 1.3–1.34-acre unified property at 3047 North Federal Highway; the site plan language read into the record described the proposed structure as 4,733 square feet.

The meeting adjourned at 6:10 p.m.; commissioners offered brief congratulations to the applicant after the approvals. The ordinances were adopted on second reading and will take effect according to the effective dates set in those ordinances.
