The city attorney explained that, because the organization affirmatively gave up its CUP in writing, the city may document that relinquishment administratively rather than conducting a formal revocation hearing.
The city attorney said the administrative route involves responding to the applicant in writing and placing the correspondence in the case file as proof that the permit was relinquished. "If you do it administratively, we write to them and we say, we heard from you in writing that you're not there...and that you support revoking the CUP," the attorney explained.
Commissioners asked whether the administrative approach provides an adequate public record. Staff confirmed a response letter had been sent and that the correspondence would be included in the next meeting packet for public transparency. Chair Sherrick polled the commission and a majority indicated they were "okay with the letter" and handling the matter administratively rather than holding a formal revocation hearing.
No formal motion to hold a public hearing was made; staff will include the applicant’s letter and the city's response in the next agenda package and document the administrative revocation in the file.
