The Ascension Parish Board of Adjustments on Feb. 11 denied a variance request (PZ3858.26) for an upgraded shop and attached lean‑to that encroach on the side setback and were constructed without permits.
A representative for Franklin Gomez told the board the shop was remodeled and re‑sided to match the house and that the family cannot move into the main dwelling until the variance and permitting issues are resolved. “Nobody has moved in until we've filed the variance, unfortunately,” the representative said.
Staff and board members described the encroachment as approximately 7 inches from the property line and stressed that construction without permits complicates compliance. A board member noted that without resolving the setback the parish would not issue a certificate of occupancy. No members of the public signed on to speak at the public hearing.
After discussion, Devin moved to deny the variance; Eddie seconded and the motion to deny carried. The denial means the owners must either remove the encroaching elements, apply for appropriate permits and engineering documentation, or seek other remedies under parish regulations before a CO can be issued.
