The Rutherford County Board of Zoning Appeals on Feb. 12 approved a special exception allowing Ramon and Lakeisha Guzman to keep a 44-by-14 accessory structure on a vacant lot at 2483 Taylor Lane before constructing a primary residence.
Planning staff told the board the vacant lot, recently platted as part of the Prairie Sunsets subdivision, currently contains the accessory building and that the structure was installed without a building permit. Staff recommended special-exception approval with a condition that permitting staff verify the required 40-foot front setback before final permitting.
"It was placed on the property absent a building permit," planning staff said during the presentation, and added that callers who inquired about the application raised questions but did not indicate opposition. An applicant representative confirmed the presentation and said the applicants have engaged an architect and intend to build the principal structure “as soon as possible,” later clarifying a two-year target for breaking ground.
Board members asked staff how a front yard is determined where lots are set far back from the public road. Planning staff said the front yard is measured from the boundary through which the property is accessed.
A motion to approve the special exception "subject to staff comment" was made, seconded and carried on a roll-call vote recorded in the transcript as 'yes' from Mike Curtis, Amber Brown, Jerry Sartain, Renee Curtis, Patrick Hale and Zane Cantrell.
The board did not place additional conditions on the timeline beyond the permitting verification; the applicant had told the board they expect to begin construction within about two years. The permit verification means the accessory structure’s placement will be reviewed against setback and other zoning requirements during the formal permitting process.
The BZA moved on after the vote; no other appeals or enforcement actions were recorded in the transcript related to this parcel.
