Board allows existing shed at 3373 Campbell Road to remain despite setback encroachment

The Smyrna License and Variance Board unanimously approved Variance V26009 to allow an existing accessory structure at 3373 Campbell Road to remain with a reduced rear setback of 1 foot.
Joey Sobs, Planner II with Community Development, said the shed is roughly 78 square feet and did not previously require a permit because structures under 200 square feet are exempt from permitting. "They submitted plans for a pool and upon that submittal, we noticed there is a shed in the back of the property," Sobs said, and recommended approval with two conditions: adherence to the submitted site plan and that any portion of the southern shed wall encroaching closer than 5 feet be treated with fire-retardant paint or otherwise addressed as required by the chief building official prior to pool permit completion.
Reeves Newsome, the contractor for the homeowner, confirmed the presentation and said his firm has built many pools in Smyrna with similar accessory structures. When asked by the board whether the shed was for pool-related use or storage, Newsome said it is "just storage" for garden equipment and tools.
With no public opposition, an unidentified board member moved to approve V26009; after a second the chair announced the motion passed unanimously. The transcript does not record individual roll-call votes.
