License and Variance Board approves setback reduction for 2740 Cumberland Boulevard

The Smyrna License and Variance Board unanimously approved Variance V26008 to reduce the rear setback at 2740 Cumberland Boulevard from 50 feet to 9.7 feet.

Joey Sobs, Planner II with the Community Development Department, told the board the property was originally developed in 1983 as a roughly 6,000-square-foot building and that the proposed addition would make the structure about 7,500 square feet and house 35 salon suites. "Since 1983, our code has changed. We now require a 50 foot rear setback. So, therefore, they're requesting a setback reduction from 50 feet to 9.7," Sobs said, and recommended approval with two conditions.

The conditions Sobs described require substantial compliance with the submitted site plan and elevations and that the applicant permanently remove an existing driveway curb that would be obstructed by the addition. The applicant must extend the raised curb median and reconstruct the curb to create a drive aisle at least 12 feet wide to provide dumpster access and ensure proper drainage.

An unnamed representative for the applicant said the developer, Capital City Properties, is a local Cobb County company that has operated for more than 25 years and seeks to modernize the older building to attract tenants. The representative confirmed agreement with the two conditions.

With no members of the public speaking for or against the request, an unidentified board member moved to approve the variance. After a second, the chair announced the motion passed.

The board did not record individual roll-call votes in the transcript. The motion language named Peter Bright as the applicant.
