Subcommittee reviews agency rule updates; insurance, elections and treasurer rules approved

The Administrative Rule Subcommittee voted without objection to review and accept several agency rule updates during its Jan. 16 meeting.
Insurance regulation: Arkansas Insurance Department representatives presented an amendment to 23 CAR part 9 (holding company system rule) to adopt the National Association of Insurance Commissioners model regulation and add a group capital calculation requirement following the General Assembly’s companion model law (Act 261). The committee reviewed the amendment and approved it without objection.
Elections: The State Board of Election Commissioners presented two rules. The first clarifies the role of poll watchers and defines channels of communication when poll watchers observe unresolved issues in a polling place. The second amends certified election monitor pay, increasing daily compensation from $100 to $300 and defining training, observation and report-writing pay. Both rules were reviewed and approved without objection.
Treasurer of State: Michael Harry, chief compliance officer and director of government affairs, told the committee the Arkansas Financial Education Commission is removing diversity, equity and inclusion membership requirements from its rules to comply with recent statutory changes; the committee reviewed and approved the request.
What's next: The committee filed monthly written updates on outstanding rules from the 2023 and 2025 regular sessions and accepted the Division of Higher Education’s report recommending three repeals and continued enforcement of other rules. The subcommittee adjourned after completing its agenda.
