The Zionsville Board of Parks and Recreation on Feb. 11 tabled a proposed rewrite of the shelter-reservation policy after board members raised concerns about treating nonprofit organizers differently from for-profit users and about how the policy would interact with special-event permits.
Jared, the parks superintendent, explained the updated policy’s intent: to delineate premier shelter reservations, clarify exclusive-use term lengths and align fees with prior board-approved schedules. Several board members argued the policy as written risks privatizing large portions of parks, and one member said, "I think a park should just be a park for people to come and enjoy," urging that nonprofit reservations receive similar scrutiny to for-profit reservations. Legal counsel cautioned that content-based or overly broad restrictions on assemblies in parks can face First Amendment challenges and recommended carefully scoped, neutral time–place–manner restrictions.
Board members asked staff to pursue an executive-session discussion and return with revised language addressing: - Whether nonprofits should require the same board approval as for-profits for reservations that limit access; - Clear criteria distinguishing routine shelter reservations from special events that effectively occupy a whole park; and - Timeframes and enforcement protocols that comply with constitutional constraints.
The motion to table passed unanimously; staff will present refined language and legal analysis at a future meeting.
