Commissioners delay vote on revised Rad curbside contract, ask for legal review and work session

Rad Ownership, the county's curbside waste franchisee, submitted a revised contract to the county that would change operational hours, remove subcontracting prohibitions and alter ownership constraints. Public Works Director Daryl Johnson told commissioners he did not support the franchisee's changes and recommended the board not approve a document that staff and county counsel had not yet vetted.
Johnson read examples of provisions that had changed from the county's current agreement, saying performance and bond language had been removed and that dispute-resolution and severability language differed from the county's existing protections. "My recommendation is not to approve this contract that's that's presented by the franchisee," Johnson said, urging legal review and a work session with the franchisee and staff.
Dave (Rad ownership) told the board he had been asked at a quarterly meeting to draft contract updates and had worked on the revision over the Labor Day weekend, saying some changes were meant to modernize the agreement and align county and municipal contracts. He asked commissioners to consider certain ownership changes and rate-adjustment provisions.
After extended discussion commissioners asked staff and legal to prepare a packet for a work session; a special meeting and legal review were scheduled to allow staff and Rad to negotiate acceptable language before returning to the board. No contract was approved at the meeting.
