Staff told the board that five companies submitted proposals and that the two lowest bids came from Ryan Incorporated and Perry. Staff said Ryan conducted on-site testing before bidding, which helped the company estimate the proportions of dirt and trash and likely contributed to a lower price. The county cited a $631,000 estimate from Ryan and said, under the Virginia Public Procurement Act, it is required to negotiate with the two highest-scored offers.
Officials described the technical problem as legacy overfill in Phase 1 cells, with some areas 3 to 6 feet overfilled and other areas up to about 19 feet overfilled; staff said some areas exceed permitted landfill airspace under DEQ rules. The proposed remediation is to regrade by moving over-elevation material into existing underfilled cells where possible, using survey flyovers and topographic mapping. Staff said the plan aims to avoid jeopardizing a planned new cell but acknowledged there is a chance some material could need placement in the new cell.
A board member noted that DEQ had raised the overfill with prior management several years ago and asked whether the county could recover costs from the previous operator; staff did not report recovery of funds at the meeting.
A motion to allow the county to award a contract not to exceed $631,000 was moved and seconded; the chair recorded the mover as Mr. Vaughn and the seconder as Mr. Cubbage. The chair called named votes for Mr. Guzy, Mr. Cubbage, Kyle and Mr. Vaughn and the motion carried.
County staff said Ryan Incorporated had performed test pits and hired a local excavating firm to calculate elevations and likely quantities, and that staff prefers Ryan because of that pre-bid work and recent relevant experience. The board did not authorize a specific contract award to a named vendor at the meeting beyond allowing staff to finalize an agreement consistent with procurement rules.
Next steps: staff will proceed with negotiations with the two highest-scored bidders and finalize the award consistent with the Virginia Public Procurement Act.
