Neighbor counsel Michelle Rosenfeld argued the revised materials—she said they included significant changes to stormwater management, a long retaining wall that runs near the shared property line, and added impervious coverage—were provided only 10 days before the hearing and her client’s engineer could not complete a thorough review. Rosenfeld told the council a short postponement would allow technical experts to examine the plans and preserve the neighbors’ ability to present substantive evidence: "Any arguments that we don't present to the council tonight are waived," she said.
Applicant counsel Matt Gordon countered that the materials were in the record and the applicants believed the submission met town requirements. Councilors questioned distances, retaining-wall heights and stormwater impacts; Cass Engineering (the applicant’s engineer) explained the retaining wall runs about 71 feet parallel to the property line and that Montgomery County review was pending but resubmissions were in process.
After deliberation focused narrowly on the continuance request and on obtaining a fuller Bayland (stormwater) report and staff notes, the council moved and approved continuing the hearing to Feb. 24 and asked staff to provide a more substantive stormwater analysis before that date.
Next steps: the hearing record will be reopened on Feb. 24 for the amended application; staff will seek to provide Bayland’s detailed review and confirm availability of the applicant and neighbor representatives.
