Council continues public hearing on proposed tobacco and vape retailer rules after debate on buffer zones

City staff presented a draft ordinance (Lincoln Municipal Code, new chapter 3.8) that would create new local rules for tobacco and vape retailers, add a citable possession offense for people under 21, prohibit sales of certain products (kratom, novelty candies, disposable glass pipes and CO2 canisters known as "whippets"), and require at least 1,000 feet between new retailers. Staff emphasized enforcement options that allow cited individuals to appeal by paying the fine and then completing an educational class to have fees returned.
In public comment, a local parent supported the ordinance after describing her daughter's vaping incidents at school and commended city-school coordination. Council debate focused on the 1,000-foot buffer and which uses to include (parks, elementary schools, junior-high/high-school, other tobacco retailers). Several council members suggested a larger buffer (2,000 feet) or removing certain uses from the distance calculation to avoid unintentionally banning all future retailers. Council member Reedy and others noted the draft reflected direction given at a prior workshop but asked staff to refine the map and distance logic.
Council decided not to take final action and continued the public hearing to the first meeting in March to allow revisions and to get input from an absent council member who had been invested in the item. Staff said they would return with a revised draft that reflects council direction. No ordinance was adopted at the meeting.
