Council denies FOIA fee appeal after closed-session review

City Attorney Mr. Thomason told council the petitioner (recorded as Frank Cacus, with variant spellings in the record) had submitted material disputing the city's estimate and asked that the appeal be decided on the written record. The attorney said the city's estimate is a good-faith fee estimate and recommended the council "enter a motion to deny the appeal of the fee request."
Councilman Waticia moved and Councilman Knox supported the motion to deny the petitioner's FOIA appeal as presented in closed session and as recommended by the city attorney; the motion carried by voice vote and the appeal was denied.
Earlier in the meeting the council had moved into closed-door sessions under MCL 15.2681(h) to discuss attorney-client privileged information related to the FOIA matter and to consider employment and contract matters. Roll-call votes to enter each closed session were recorded as seven affirmative votes.
The council did not disclose privileged details discussed during the closed sessions. The formal denial of the fee appeal concludes the council action recorded in open session for this agenda item.
