The Newark City Council on Jan. 22 approved zoning changes intended to bring the city's accessory dwelling unit (ADU) and junior ADU (JADU) rules into compliance with recent state law and to add local incentives to encourage ADU construction. Council members voted 4–1 to adopt staff's recommended text amendments with one change: the council eliminated a staff-proposed extra 2-foot height allowance for detached ADUs.
Associate planner Joseph Blotbat, presenting the item, said the proposed amendment updates NMC section 17.26.040 and the use classification in 17.45.010 to incorporate state-exempt ADU rules, simplify setbacks and height limits, and add incentives on height, size and impact fees.
