District says about $2.2M of ESSER 3 late-liquidation funds frozen as it awaits state review

Jeff, reporting on communications with the state, told the Colonial School Board on April 8 that the district was asked to submit documentation regarding ESSER 3 funds that remain in "late liquidation" after a federal decision to freeze late-liquidation reimbursements. He said the district has submitted descriptions of purchases, explanations of their importance, and answers about potential impacts if those funds are not released.
Jeff estimated approximately $2,200,000 remains in late liquidation and has been frozen pending review by the Delaware Department of Education and the federal Department of Education, and he said the department's memo described an appeal process. He added that much of the communication came indirectly through state chiefs rather than directly to the district, and staff are waiting to see how state and federal agencies will resolve the requests.
Separately, Jeff summarized other federal notices the district has seen, including a FERPA-related communication the district received directly and state-level reminders about Title I expectations. He said the district's legal counsel reviewed notices about Title VI and advised that the changes being discussed at higher levels do not appear to apply to the district's K-12 operations.
District staff also said they have not been alerted to interruptions in other entitlement grants or child nutrition reimbursements and are tracking a separate continuation grant from the Division of Substance Abuse and Mental Health that remains pending.
The board did not take an immediate vote on funding decisions; staff said they will continue communication with state officials and report back when additional information is available.
