Subcommittee clears bill to let petitioners allege marriage fraud in domestic-violence injunctions

Representative Daniels told the subcommittee PCS for HB 485 would add a checkbox to domestic-violence petition forms allowing petitioners to allege marriage fraud and clarify that marriage fraud occurs when a person is induced to enter marriage by a noncitizen for the primary purpose of evading state or federal law to obtain benefits. "It requires the clerk of the court to notify the State Board of Immigration Enforcement within 24 hours after the court issues a domestic violence injunction in which the petitioner is alleged to be a victim of marriage fraud," Daniels said.
Daniels said the bill received 100% bipartisan support at the last stop. Barney Bishop of the Florida Smart Justice Alliance waived in support during public testimony. Representative Jacques praised the bill as "common sense accountability" and the subcommittee voted 14-0 to report favorably.
The sponsor said staff previously handled the measure in earlier stops and the passage in subcommittee allows for continued movement through the legislative process.
