Council approves amendment to 100 East deferral and awards $900,214 roadway contract

Cedar City's council voted Dec. 10 to approve an amendment to deferral agreements for 100 East frontage improvements and to award the 100 East roadway construction contract to Intellect LLC for $900,214.85.

Staff presented two options for meeting frontage obligations on properties with deferral agreements: accept in‑kind work and materials from property owners (staff estimated the proponent’s offer at roughly $109,000 in materials and labor) or accept a cash payment (calculated from bid prices at about $72,489.75) and have the city perform the work. Several councilmembers expressed unease that a proponent was not present to answer questions and urged caution about bypassing a formal bid process. Staff said they had verified prices and that the in‑kind option provided greater value to the city based on current estimates and bids.

Councilmembers also debated whether accepting a cash payment would obligate the city to re‑bid materials and whether economies of scale favored the in‑kind option. After motions and discussion, council approved the amendment option that allows the owner to supply the materials and work under the terms presented.

Separately, the council approved a $900,214.85 bid award to Intellect LLC for the 100 East roadway improvement project and added a contract caveat that adjustments could be made to reflect the double‑chip‑seal portion and other clarifications discussed in the meeting. The contract award carries direction to staff to finalize terms so trigger dates for property deferrals and a 30‑day completion window for owner‑triggered work are enforceable.

Council then adjourned the public meeting and moved into closed session to discuss property negotiations related to the project.
