The Cedar City Planning Commission voted on Oct. 21 to recommend an amendment to the city's pool-safety ordinance to allow powered safety covers that comply with ASTM F1346 to be used instead of mandatory fences.
Staff presented the proposed language adding a clause that, when a pool is equipped with a powered safety cover meeting ASTM F1346, a fence is not required. Amber (staff) said the change responds to a Board of Adjustments review and aims to bring the city code into alignment with state law. An audience member asked whether a cover automatically secures the pool area and whether liability remains if a cover is left open or broken; staff and the legal advisor said covers meet spacing and weight standards but that mechanical failure or failure to maintain a safety device could raise liability concerns.
Commissioner (speaker 4) moved to recommend modification of ordinance revision 26-4-9 to allow compliant powered covers in lieu of fences; the motion was seconded and carried by voice vote (Aye; no opposition recorded).
