Council members and staff noted two practical constraints: (1) the parcel available now is smaller than previously leased because MCO expanded and because future right-of-way for 100 East reduces leasable acreage; (2) the city’s current lease policy requires public procurement best practices for purchases and may not allow automatic restoration of an old lease at identical terms. Legal staff recommended reinstatement be handled by calculating a current market-based base rent (with percentage rent elements) and pro-rating for reduced acreage.
Council discussed adding milestones to prevent a long-term land lease from lying fallow (examples: a 10‑year term with a building-permit trigger and a 2‑year construction completion requirement). Staff will analyze the old contract and bring back recommended terms and a pro‑rata rent calculation at a future meeting.
