Council hears two land‑use items: a right‑of‑way/easement vacation and a fencing setback agreement

Two planning items drew council attention during the April 30 work meeting.
On the first item, Daryl Brown of Watson Engineering described a client’s request to vacate an oddly shaped former right‑of‑way parcel and an existing 20‑foot public utility easement to enable a minor subdivision. Brown said UDOT previously quit‑claimed a portion of the Main Street right‑of‑way, generating the odd parcel. City staff said they are "fully on board" with vacating the easement provided a new public utility easement is dedicated adjacent to the right‑of‑way line and any hidden utilities discovered must be relocated at the applicant’s expense. The mayor opened and, seeing no public comment, closed the hearing and placed the item on action for the next meeting.
On the second item, Phil Schmidt, representing the applicant, explained a development agreement to allow a wall at the property line where existing ordinances would otherwise limit that placement. Councilmembers asked whether barbed wire or future additional fencing would be permitted; staff and the city attorney said barbed wire is not allowed and any additional changes would require the applicant to return and seek council approval. No public testimony was offered and the item was moved to action.
Both items will return for formal council action at a subsequent meeting.
