The commission reinstated an expired conditional approval for a proposed Popeye’s restaurant with drive-through at 701 North 19th Street and granted a 12-month extension measured from Jan. 13, 2026, setting a new effective extension date of Jan. 13, 2027.
Planning staff explained state municipal planning code protections and the updated SALDO five-year policy that supports reinstatement and extension. "Nothing in the MPC or the SALDO entitles a reinstatement of an expired development plan...that being said, the municipal planning code section 5.08 protects developers from changes...for up to 5 years," staff said.
Adam Anderson, the civil engineer on the project, briefed the commission on outstanding PennDOT permits (driveway, sidewalk, and utility applications), the sidewalk and 'no parking' ordinance coordination, and estimated a summer timeline for final approvals but asked the commission to allow up to the requested 12 months.
After clarifying that the extension would be measured from the meeting date, the commission approved the reinstatement and the 12-month extension by voice vote. Staff and applicant will continue coordination with PennDOT, LCA, and other agencies to finalize remaining permits.
