Council approves amendment to Lassen Townhome development agreement to resolve right-of-way issue

The council unanimously approved a second amendment to the Lassen Townhome development agreement, allowing the project (186 townhomes, 14 affordable units) to proceed after the developer said it could not negotiate a necessary right-of-way with an adjacent owner. Emily Ladue, assistant planner, said staff negotiated preliminary terms to acquire the needed right-of-way and recommended relieving the applicant of acquisition obligations while requiring the developer to design and permit off-site improvements (sewer replacement, trail, median improvements).
The planning commission had unanimously recommended approval on June 17, and staff recommended the council find the proposed amendment’s environmental impacts were within the scope of prior documents and to direct the planning manager to file a notice of determination consistent with CEQA.
Council members expressed support for completing critical off-site connections and for moving the project forward. The motion to approve staff recommendations was seconded and passed unanimously.
Next steps: staff will file CEQA notices and proceed with implementation of the amended agreement to allow design, permitting, and construction coordination.
