Board approves Lennar stipulation change removing 55+ restriction near Sun City after public comment; one supervisor recused

The Maricopa County Board of Supervisors approved item 5 on Feb. 11, 2026, a stipulation modification for a Lennar subdivision on 99th Avenue that removes a prior condition requiring one resident in the subdivision to be 55 or older.

Public speaker Louis Mar Garza urged caution, citing past complaints about Lennar in other states and warning that removing the 55+ restriction could increase traffic pending a traffic study. Ashley Marsh, appearing for the applicant, said the community is largely built out, construction has begun, the plat and a traffic study have been completed and the request aims to remove what the applicant called an "arguably unenforceable stipulation."

Supervisor Lesko (transcript spelling varies) said she had met with the applicant, requested they consult the Sun City Homeowners Association, and reported that the HOA had no objections. Supervisor Galvin announced a recusal for the item. The board moved and seconded the motion to approve the item and, after a roll call, the motion passed with one recusal recorded.

The action modifies a zoning agreement condition; the vote did not change county zoning classifications or impose new county policies beyond the recorded amendment to the stipulation. The chair noted opposition had been heard and the applicant had addressed concerns before the board voted.
