West Valley City Council approves public-certificate, building-code and water-use items; adopts interagency agreement for shelter mitigation

The West Valley City Council on Nov. 25 approved a set of routine and statutory items designed to meet state requirements and support local programs.
Ensign Learning Academy: By unanimous vote the council approved Resolution 25-171, a public approval certificate required to satisfy a public-notice obligation for conduit financing. City staff attorney Jim Welch explained the council's role is ministerial: holding the hearing and signing the certificate so the academy can proceed with financing. "All we have to do is hold a public hearing and give the public the opportunity to express their opinion on the bond sale," Welch said.
Wildland-Urban Interface code: The council adopted Ordinance 25-34 to incorporate the 2006 Utah Wildland-Urban Interface code, including state amendments, citing eligibility for fire-mitigation funding as the practical reason for adoption. No public speakers addressed the hearing and the ordinance passed unanimously.
Water-use and preservation element: The council approved Ordinance 25-35 to adopt a water-use and preservation element in the city's general plan. The item implements a 2022 state requirement (referenced in the meeting as "SP 110") that local governments adopt such an element on or before Dec. 31, 2025.
Consent agenda: Council approved seven consent items by a single motion, including an MOU with the state for cultural center programming, a professional services agreement with Horax Engineers, a federal-aid agreement with UDOT, an interlocal agreement with Magna City for $7,200 in improvements, deeds and easements, and the appointment of Adriana Ramirez to the planning commission.
Shelter mitigation funding: In new business the council unanimously approved Resolution 25-179 authorizing an interagency agreement with the Utah Department of Workforce Services to provide mitigation funding intended to offset increased public-safety workload tied to a temporary overflow homeless shelter.
All votes reported at the Nov. 25 meeting were recorded as unanimous on the items above; separate contested items (the GPZ/rezoning) were continued to Dec. 9.
