City tables Beacon Builders appeal over Acuff Road closure after contractor cites unmapped utilities

The Bloomington Board of Public Works reviewed a notice of violation against Beacon Builders for failing to reopen Acuff Road after a permitted closure. Engineering staff outlined a timeline showing the permit period, a notice of violation issued on Sept. 29, 2025, and an administrative extension to Oct. 3, 2025, with the road remaining closed until Oct. 6, 2025. Staff recommended upholding the notice of violation.
Beacon Builders’ attorney Jim Bohr said the contractor encountered unforeseen site conditions, including a fiber‑optic line not mapped in city records, multiple unmapped water valves and a failed subbase compaction that required rework. "They found a fiber optic line. It wasn't mapped on any of the city's maps... Then they found a water valve. It wasn't on the locate. It wasn't on the map either," Bohr said, describing the complications.
Public Works Director Adam Wason suggested tabling the appeal to allow further negotiation with the developer. Board member Elizabeth Karen moved to table the appeal; the motion passed 3–0. The board will revisit the appeal at a subsequent meeting.
The board did not make a final ruling on the notice of violation at that session.
