County legal counsel advised the board that the request — described in staff materials as a potential "down zone" — lacked legal support under Virginia zoning law and case precedent. Counsel told the board that courts consider neighborhood character and protection of established residential areas when evaluating rezoning and that the parcel’s surrounding lots appeared well maintained and residential in character. Counsel also cautioned board members not to interpret state code themselves and warned that granting the rezoning could create precedent inviting similar requests from other neighborhoods.
An applicant representative and other speakers said the family sought rezoning because local zoning and deed covenants created confusion around whether their companion animals qualified as livestock under zoning rules, and they sought compliance rather than noncompliance. Applicants argued that other lots in the subdivision were agriculturally zoned and being used for residential purposes, and they expressed frustration that the covenant had not been disclosed at purchase.
After discussion, a supervisor moved to deny the rezoning request; another supervisor seconded. The motion carried 6-0.
