City Attorney staff cited an email from counsel saying the vendor would be out of the country for the original date (March 2) but available on March 16; commissioners voted to set the consolidated appeal date by roll call. Commissioner Petrie asked whether the email stated the new controls would already be in place by March 16; staff said the email did not claim the measures were already implemented.
The Commission's action was procedural: it established the hearing date and notified counsel. Any evidence regarding odor controls and vendor proposals will be heard at the March 16 hearing.
