Commissioners approve reciprocal easement swap at county sewer lagoon

Ben McDonald of the Park County engineer’s office presented a proposed reciprocal easement exchange with the Laughlin Revocable Trust and NLRE LLC at the county septic receiving facility, asking the board for a resolution to proceed subject to county attorney approval. He described approximately 1,200 feet of 60-foot-wide county easement in exchange for about 900 feet of easement from the landowners.
McDonald said the county had discussed the matter for years and provided an exhibit of the proposed easement alignment. A commissioner noted that the sewer lagoons are slated for abandonment once the city of Cody takes over service, and that remediation (drying, excavation, sludge removal and backfill) could take three to five years after closure. "Once we close, I think it's 3 to 5 years," McDonald said.
A motion to approve the easement resolution, subject to the county attorney approving form for recordation, was moved, seconded, and approved by the board. The clerk assigned resolution number 2026-06. The board discussion indicated the swap is intended to preserve access and flexibility for future development of those parcels along the edge of town.
Next steps: county staff will finalize easement forms with the county attorney and record the exchange following standard real-property procedures.
