Committee passes amended administrative-license-revocation bill after judges warn of cost and staffing burdens

The Senate Committee on Transportation voted to pass SB 3182, which would revise administrative driver's license revocation procedures, after incorporating an SD1 amendment and other changes aimed at addressing operational concerns.
A judiciary representative told the committee the bill, as drafted, would force the administrative hearings office to mail entire case files to respondents within five calendar days of receipt, an obligation the representative said would be costly and operationally infeasible given current staffing. "We currently process about 3,000 to 4,000 DUI cases statewide each year," the judiciary representative said, and certified-mailing files that can be "60 to a 100 plus pages" to multiple addresses would require additional staff and raise significant costs. The witness warned missed deadlines could require rescinding revocations, creating public-safety concerns.
Deputy Attorney General Michael Moriyama recommended the committee consider a proposed SD1 that had been drafted by county prosecutors; Daniel Hugo of the Honolulu Prosecutor's Office said SD1 would "alleviate the concerns" noted by the judiciary and add a presumption of revocation that would simplify prosecution in related criminal cases.
After discussion the chair recommended passing SB 3182 "with the amendments" and attaching SD1. The committee recorded aye votes from the chair, vice chair and the other members present, adopting the chair's recommendation.
The committee's action advances SD1 and sends the amended bill to the next committee(s) for further consideration.
