Chair Ty Mencer read the statutory authority for the closed session and said the board would meet "pursuant to RCW 42.30/42.31" to discuss agency enforcement and potential litigation and that the session would be about 20 minutes. The board returned to open session shortly thereafter and the chair reported that board members had follow-up questions for counsel and that additional executive-session time is likely.
Because state law authorizes executive sessions for attorney-client deliberations, details of the counsel discussion were not disclosed in open session.
