Magna adopts MSD privacy program to meet state transparency law

The Magna City Council voted to adopt Ordinance 2025-O-24 to implement the Magna Service District (MSD) privacy program required under House Bill 44. City manager David Birkey told the council that state law requires municipalities to publish policies explaining what personal data are collected, where they are stored and how they are used.
"You have until the end of this month to enact a policy that provides both transparency if anybody wants to look up what's being done with their data," Birkey said, describing roles identified in the draft: the MSD chief administrative officer (named in the packet) and the recorder as the administrative records officer. He told the council the required report is ready for submission should the council approve the ordinance tonight.
Council moved, seconded and approved the ordinance by voice vote. Birkey emphasized the policy can be amended by future councils and does not represent an irrevocable change. The city manager noted the ordinance prohibits sale of the data and is intended to provide public clarity about data practices.
The council’s action authorizes staff to submit the statutorily required report and to publish the privacy program information to the public records portal. No roll-call vote was recorded in the meeting transcript; the approval was captured as a voice vote.
