Attorney Divina Harden presented the petition and staff analysis, saying the school was designated high performing on the California Department of Education’s performance list. Under recent changes to the Charter Schools Act, high‑performing charters are eligible for five‑ to seven‑year renewal terms; staff recommended a seven‑year term in part because the renewal petition and an accompanying memorandum of understanding met the criteria described in Education Code sections 47605 and 47607.
Board members asked about the MOU review process during the seven‑year term. District and El Rancho representatives said the MOU can be reviewed annually or as needed and that the renewal would remain in effect unless the parties negotiate a replacement MOU or expressly terminate the existing one. Trustee Ortega moved to adopt the resolution and include the staff recommendation; Trustee Ortega’s motion was seconded and carried 6–0–1.
