Committee Accepts Amendment to HB192 Limiting PBM Steering, Adds Transparency Protections

The committee took House Bill 192 out of order for its fourth hearing. Representative Barhorst moved amendment AM-1041-2 and explained it would remove a prohibition on pharmacy reimbursement differentials imposed by PBMs, add technical language to reflect fields from Ohio's 2017 prescription drug price transparency law, and prohibit PBMs from preventing pharmacies or dispensing physicians from partnering with third parties that improve price transparency or patient access.
"This amendment basically prevents steering within the industry and the predatory business practices that small pharmacies are experiencing currently in the marketplace," Representative Barhorst said, adding the change would allow patients to authorize third‑party apps without penalty and count violations as unfair or deceptive insurance practices.
The chair distributed the amendment to committee members and asked if there were objections. Hearing none, the amendment was accepted and the chair concluded the fourth hearing on HB192.
