Committee adopts amendment to HB392, broadens 'physical data center' to 'computational resource'

Vice Chair Workman moved to amend House Bill 392 at the House Technology and Innovation Committee and briefly explained the change before the panel adopted the amendment without objection.
Workman said the amendment "specifies that a compelling governmental interest under the bill includes an interest in protecting the public, removes preventing public nuisances as an example of a compelling governmental interest, and broadens the term physical data center to computational resource." The amendment was on members’ iPads for review.
Chair Clagett confirmed the motion and, with no objections raised, stated on the record, "Without objection, amendment AM 1,361,295 is adopted into house bill 3 92." The committee concluded the bill’s third hearing and indicated it would take up the measure in more detail at a later meeting.
The amendment changes the statutory framing in the bill by clarifying government interest language and replacing a location-based term with a broader technical term; committee members did not debate the amendment further during the session.
