Planning staff said surveys and building-permit records revealed that a recently built covered patio and existing structures extend across historic lot lines, creating setback violations that had not been detected earlier. Surveyor Tipple Hill and Coastal Eye Care owner Dr. Scott Tress told the board the requested action would clean up historical title and condominiumization issues and allow the parties to have separate fee-simple lots.
The Board of Appeals had produced no action on the variance request (a 2–1 result where 3 votes were required), which state law designates as a denial. Commissioners voted to reverse that denial and allow the appeal to proceed so the property owners can correct the record and pursue a legal lot split.
