Clerk warns of halted property recordings without millage resolution; board authorizes temporary measure

Amy Muse, Haralson County’s clerk of court, told commissioners she cannot process real‑estate recordings for 2026 until the county and city provide official millage rates on the required PT‑35/PT‑38 forms. Muse said that without those forms her office would be forced to pause recording deeds and other instruments, disrupting closings and attorney work.
"I cannot move forward in 2026 in my real estate department with security deeds, quick claim deeds, or warranty deeds if the millage rates aren't set," Muse said, and requested a resolution permitting her to use the current millage rate until formal rates are submitted. The board discussed options for an oral resolution and asked the county attorney to prepare a document for the chairman’s signature; Unidentified Speaker 3 moved to adopt a temporary resolution allowing the clerk to act under the current millage, the motion was seconded by Unidentified Speaker 2 and passed.
Muse also raised one other item: a juvenile court stamp machine that is beyond repair and for which parts are discontinued. She presented an invoice from Georgia Time Recorder for $1,142 to replace a single stamp machine; the board indicated the chairman could approve the purchase from equipment funds without a separate full board vote.
The clerk said once the formal millage rates are available she will update her vendor and database to reflect the new rates going forward.
