Kirkland postpones approval of updated school-district joint-use agreement after maintenance concerns

The City Council on Feb. 17 postponed action on a revised joint-use agreement with the Lake Washington School District after council members pressed staff to secure clearer maintenance standards and enforcement remedies for athletic fields the city previously upgraded.

City staff summarized a negotiated update that responds to the district's decision to centralize scheduling: under the draft agreement the district will resume scheduling and primary maintenance of most school fields (with limited exceptions such as Lakeview Elementary), while the city will retain certain responsibilities and gain half-hour extensions for gym access. Staff described labor- and utility-savings the city expects to repurpose for parks priorities.

Several council members said they were concerned the district's maintenance standards could be lower than the city's previous practice — a particular concern because city funds had paid for upgrades on some fields. Council Member Pasco asked for written assurances in the ILA that the district will maintain renovated fields at levels comparable to city standards. Deputy Mayor Black asked staff to identify enforcement remedies — including whether the city could seek specific performance rather than terminating the agreement if a breach goes uncured.

Given the outstanding questions, the council voted unanimously to postpone approval to a future meeting and directed staff to reopen discussions with the district to clarify maintenance standards and enforcement mechanisms.

Next steps: staff will negotiate follow-up language with the district to clarify maintenance standards and remedies and return to council at a later meeting.
