Rules team reports timeline for alcohol and cannabis rulemakings; petitions under review

Kevin from the rules program briefed the board caucus on Feb. 3, saying the rules program has 10 open projects and is actively preparing CR102 and CR103 filings related to alcohol and contract-kitchens implementation of recent laws.
He said public comment for the retail alcohol product-placement draft closed on Jan. 16 and the agency will begin an economic analysis about March 1 that is expected to take roughly three months; the agency plans to file a CR102 this summer and intends to delay the rules' effective date until 2027 to give businesses time to adapt.
Kevin reported that public comment on the contract kitchens draft closed on Jan. 23 and that late stakeholder feedback has pushed the CR102 filing to next month, with a subsequent CR103 in April dependent on board approval. He also said the rules team will present a request next month to repeal three WACs invalidated by a court order (numbers cited in the briefing) and that much of the statutory basis for those WACs remains in effect.
On cannabis, Kevin said work continues on advertising and retail management agreement rules to implement recent legislation, and on R&D testing/sample rules; stakeholder drafts and sessions are planned for the coming weeks and months. He added the team received a petition from John Kingsbury about retail verification of patient eligibility for the medical cannabis excise-tax exemption and that the team will present a recommendation at next month's board meeting.
Board member Garrett Holmes asked how the economic analysis would be tracked; Kevin said the agency contracted a third party to survey industry participants and that the agency's research group will assist.
