At the meeting staff introduced two related agenda items concerning water companies. For item 5(a) staff said Middlesex Water Company and its subsidiaries Pinelands Water Company and Pinelands Waste Water Company filed a joint petition to approve a merger without change in control; staff described the proposal as ministerial and recommended retaining the matter for hearing, designating a presiding commissioner, and setting deadlines for parties to intervene.
Separately (item 5(b)), staff presented a joint petition involving American Water Works, New Jersey American Water Company, Nexus Regulated Utilities, Montague Water Company and Montague Sewer Company seeking approval of an acquisition and change in control of the Montague companies followed by a merger with New Jersey American Water. Staff recommended that matter also be retained for hearing with similar procedural steps.
Both recommendations were moved, seconded and approved by roll call. The board did not take a final approval on either transaction at this meeting; both matters were retained for hearing and will proceed through designated case procedures.
