Oversight board approves draft statute changes, strikes proposed inclusion of DCYF secretary

Sen. Claire Wilson presided over the Department of Children, Youth, and Families Oversight Board meeting on Dec. 17, where members approved a package of draft statute changes and struck contested language that would have specified executive‑level department representation.
Board members spent the first hour debating draft language that would add “1 nonvoting representative from the department representing the department’s executive leadership team.” Several members said the wording risked blurring oversight and administration. “I just worry about this language… I haven’t ever seen language that kind of explicitly excludes an agency head,” said Senator Claire Wilson, raising concern about how the provision might be perceived as restrictive. Representative Tom Dent argued the board must preserve independence: “We would have the power to invite the secretary in anytime we would like to, but we may have a meeting where we may not want the secretary there,” he said, urging the board not to bind itself to regular presence of the secretary or their inner team.
After extended discussion, Representative Dent moved to remove the contested section and Senator Leonard Christian seconded. The chair held a voice vote and announced the language had been removed. The board then proceeded to consider the rest of the draft package.
Judge Sharonda Amamillo moved and Shelley Willis seconded a roll call vote on the remaining set of changes. During the roll call the chair recorded a total of 15 ayes, 1 nay and 2 not present; the board confirmed the package will advance to the legislature with those edits. The board’s staff said the final package removes duplicate text, converts the annual report into a biennial report due on July 1 of odd‑numbered years, removes licensing reviews from the draft, and clarifies the board’s residence within the Office of Financial Management.
Board members also approved a narrower wording change to member roles: they voted to amend the ‘‘physician’’ slot to read “physician or advanced practice clinician with experience working with youth,” a change brought forward and moved by Dr. Diane Levy and seconded by Senator Leonard Christian.
The board’s next meeting is scheduled for Jan. 15, when members expect to continue work on statutory language and legislative strategy.
Actions recorded by the board included the voice vote to remove the secretary/executive‑leadership inclusion and the roll call approval of the revised package. The board’s chairs and staff said the document will be submitted to the code reviser and the legislature with the struck language omitted.
The meeting record shows members on both sides of the inclusion question: some members framed agency participation as necessary for implementation and relationship‑building, while others saw risks to independent oversight if executive leaders or a secretary designee were regularly present. The board left open the option to invite department leadership to specific meetings while keeping the draft statute free of the contested language.
The board agreed to send the approved draft forward to the legislature and to return to any unresolved questions about membership at a later date.
