Commission approves Level 3 conditional-use permit for Horn Shadow battery storage with conditions

Emery County commissioners on Feb. 17 approved a Level 3 conditional-use permit for the Horn Shadow Battery Energy Storage System project, with planning staff’s recommended conditions including written emergency-management plans, reclamation and decommissioning plans and appropriate bonding.
Commissioners clarified that the expanded battery storage site lies outside the county’s defined project area and therefore is not eligible for property-tax incentives associated with the project area. Staff said the CUP results from an expansion of an initially smaller battery-storage location that required relocation and additional review.
During discussion, commissioners supported including explicit written plans for emergency management and bonding requirements as conditions of approval. With those safeguards included, the commission moved and approved issuance of the CUP.
The action permits the county-level land-use authorization required for the battery storage project to proceed under the county’s conditional-use framework; other applicable state or federal permits and any developer obligations remain separate from this county CUP action.
