Hibbing council adopts revised cannabis ordinance; local cap removed, council may modify later

The Hibbing City Council adopted a revised cannabis ordinance on Jan. 8 that removes a proposed local cap on the number of retail cannabis licenses.
City Attorney Andy Borland said the draft had been revised to remove a cap that had mirrored county language after council concerns. "There is no limit now on the number that could be issued here in Hibbing for the proposed ordinance," Borland told the council, adding the draft met posting requirements for ordinance consideration.
Council members asked questions about proximity restrictions and how existing businesses and future uses (such as daycares or schools) would be handled. Borland said the city could modify the ordinance later if the council determines a cap or additional restrictions are necessary, but cautioned the city could not retroactively legislate an existing lawful business out of business.
The council approved the ordinance as presented; councilors were advised to track future state licensing developments and to consider local adjustments if a surge in applications or other issues arises.
