The Hurricane City Planning Commission on Dec. 11 voted to recommend approval of ZC25-17, a request to rezone about 1.02 acres near 100 North of Black Rock Road (from MH RV with a plan-development overlay to General Commercial). The motion passed with recorded objections from two commissioners in a 5–2 split.
Applicant Joby Vanutti of Western Commercial Real Estate said the small lots — platted in 1987 and remaining largely undeveloped — are difficult to build on as single-family units because of lot width and parking constraints. Vanutti argued the corridor along 2800 West and the connection to future thoroughfares make commercial zoning a better long-term fit.
Commissioners acknowledged the commercial frontage and potential for a future signal at 2800 West and 100 North. Several raised concerns about private HOA obligations and existing infrastructure issues inside the adjacent Canyons RV subdivision: letters from residents raised the prospect of disputes over shared utilities and whether rezoning could shift maintenance or assessment burdens. Legal staff advised the commission that private HOA covenants remain a private matter but that harmony with surrounding uses is a legitimate consideration for a zone change.
After discussion, the commission voted to recommend approval to the City Council; the applicant was advised that plat changes or private-affidavit documentation may be needed later to remove lots from existing HOA parcels or to address private utility arrangements.
The recommendation (advisory) will be forwarded to the City Council for final action.
