Dimmit County tables battery storage permit and asks county attorney for review

An application requesting approval and an electrical permit for a battery energy storage system (BESS) on FM 2367 was tabled by the Dimmit County Commissioners Court on Feb. 2 after commissioners raised procedural and technical questions.
The applicant identified herself for the record as Jocelyn Morales Baracio. Commissioners asked whether construction had already taken place, whether the system would consume water and whether the submission met open-meetings and public-notice requirements. The applicant stated the project "does not consume water" and said the location is on FM 2367; commissioners said they needed more documentation and asked staff to forward questions to County Attorney Franklin for legal review.
The judge asked staff to compile requested materials and to have Mr. Franklin evaluate the submission and the county's notification record under the Open Meetings Act. County staff noted the court had first heard a presentation on the project in September and that no construction had yet been completed at this particular location. Commissioners moved to table the item so the county attorney could review and provide guidance; the motion carried.
The item will return to a future meeting after the county attorney and staff provide a written response addressing notice, technical questions and any recommended conditions for permitting or approval.
